At Apex Home Nursing Services, protecting your privacy is not an afterthought. We are a registered-nurse-owned home care company, and we treat your personal and health information with the same rigor we bring to clinical care. This policy explains what information we collect, how we use and safeguard it, the protections we apply under the Health Insurance Portability and Accountability Act (HIPAA) and Nevada law, and the rights you have over your own information.
1. Who we are
Apex Home Nursing Services ("Apex," "we," "us," or "our") is the trade name of Apex Personal Care, PLLC, a Nevada professional limited liability company and Nevada-licensed Personal Care Agency serving Las Vegas, Summerlin, Henderson, and the greater Las Vegas valley. Apex is licensed by the Nevada Division of Public and Behavioral Health under NRS 449.1935 and the regulations at NAC 449.396 to 449.3982 (Nevada PCA License No. 12250-PCS-0). Registered nursing services, where applicable, are provided by the registered-nurse owners under their own Nevada licenses (NRS Chapter 632), coordinated by, not provided by, the agency. This policy applies to information collected through our website and in the course of providing our services.
2. Our commitment to HIPAA and the privacy of your health information
We handle protected health information (PHI) in accordance with the standards established by HIPAA and its implementing regulations at 45 CFR Parts 160, 162, and 164, including the HIPAA Privacy Rule, the HIPAA Security Rule, and the HIPAA Breach Notification Rule, as amended by the HITECH Act. To the extent Apex acts as a covered entity or a business associate under HIPAA, we comply with all applicable requirements of those rules.
Protected health information is individually identifiable information that relates to your past, present, or future physical or mental health, the care you receive, or the payment for that care. We apply the administrative, physical, and technical safeguards required by the HIPAA Security Rule to all client health information we create, receive, maintain, or transmit. We also comply with Nevada's health information and consumer-health-data protections, including NRS Chapter 629 and NRS 603A.400 to 603A.590.
The short version: We treat your health information the way HIPAA requires it to be treated. We do not sell it, we limit who can see it to those who need it to serve you, and every outside system that touches it is bound by a signed agreement to protect it.

We follow the HIPAA "minimum necessary" principle: we limit access to and use of PHI to what is reasonably necessary for the purpose at hand.
5. How we safeguard your information
Consistent with the HIPAA Security Rule and NRS 603A.210, we maintain administrative, physical, and technical safeguards designed to protect your information, including:

6. Business Associate Agreements with every system that touches your information
We do not let your health information sit in any outside system that has not contractually agreed to protect it. Every third-party platform that creates, receives, maintains, or transmits protected health information on our behalf is bound by a signed HIPAA Business Associate Agreement (BAA) obligating that vendor to safeguard your information to HIPAA standards and to report any incident to us. This includes, among others:

Our payment processing provider.
If we add a new vendor that will handle protected health information, a Business Associate Agreement is executed before that vendor ever touches your data. No exceptions.
7. How and when we share information
We never sell your personal or health information. We share information only as permitted by HIPAA and Nevada law, including:

For your care. With caregivers, our registered-nurse owners, and, with your authorization, your physicians, hospitals, home health, hospice, and family, to coordinate and deliver care.

With service providers. Only with vendors bound by a Business Associate Agreement, and only to the extent needed.

When required by law. Including mandatory reporting of suspected abuse, neglect, or exploitation of older or vulnerable persons under NRS 200.5093, valid court orders, and lawful regulatory requests.

With your written authorization. For any use or disclosure not otherwise permitted, which you may revoke at any time.
8. Your rights regarding your health information
Under HIPAA and Nevada law, you have the right to:

Inspect and obtain a copy of your health care records (NRS 629.061).

Request a correction or amendment to your information.

Request an accounting of certain disclosures.

Request restrictions on certain uses and disclosures.

Request to receive communications in a confidential manner or at an alternative location.

Receive a copy of our Notice of Privacy Practices.

File a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights without fear of retaliation.

9. Record retention
We retain health care records for at least the period required by Nevada law (NRS 629.051) and applicable federal and licensing requirements, and we securely destroy records that are no longer required to be maintained, consistent with NRS 603A.200.
10. Your Nevada privacy rights, including the right to opt out of sale
Under Nevada's online privacy law (NRS 603A.300 to 603A.360), Nevada consumers have the right to direct a website operator not to sell certain "covered information" collected through its website. Apex does not sell your covered information. Even so, you may submit a verified request directing us not to sell your covered information by contacting our designated request address at admin@apexhomenursing.com. We honor verified requests as required by law.
To the extent Nevada's consumer health data privacy provisions (NRS 603A.400 to 603A.590) apply, we maintain practices consistent with those requirements, including limits on the collection, use, and sharing of consumer health data.
11. Cookies and website analytics
Our website may use cookies and similar technologies to operate the site, remember preferences, and understand how visitors use our pages. You can control cookies through your browser settings. Disabling cookies may affect certain site features.
12. Data security and breach notification
We implement and maintain reasonable security measures to protect records containing personal information, as required by NRS 603A.210. In the event of a breach of the security of the system data involving unencrypted personal information, we will notify affected individuals in accordance with NRS 603A.220 and, where applicable, provide notification consistent with the HIPAA Breach Notification Rule. No method of transmission or storage is perfectly secure, but we work continuously to protect your information.
13. Children's privacy
Our website and services are directed to adults. We do not knowingly collect personal information from children under 13 through our website. If you believe a child has provided us information through the site, please contact us so we can address it.
14. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of our website after changes take effect constitutes acceptance of the updated policy.
